What is an encroachment?

An encroachment occurs when a property owner builds or erects something on the land of an adjoining property owner, usually along the boundary line of the adjoining properties. An encroachment can be intentionally but is more likely inadvertent, such as a the erection of a fence on what one believed to be the boundary line.
