What will be an ideal response?
A court will consider the totality of the circumstances regarding the way that the waiver was obtained and the competency of the person, as well as issues of age, intelligence, health, and ability to understand the language. The waiver must be knowing, voluntary, and intelligent. It does not need to be in writing, though that is obviously preferable.
