It is also considered to be sexual harassment when submission to or rejection of such conduct by an individual is used as the basis for reemployment decisions affecting such individuals. In addition, sexual harassment exists when such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment. Sexual harassment can occur regardless of whether the employer knew the harassment was occurring and regardless of whether it is was forbidden by the employer.
