The plaintiff had waited three years after he was denied tenure to bring his case to court. The time limit for filing Title VII charges with the EEOC is 180 days after the discriminatory act, with filing in the federal court being 90 days after receipt of a right-to-sue letter. His right to bring a Title VII action had thus expired under the time limit. Section 1981 was his only recourse.
