If plaintiff(s) were contributorily negligent-if they contributed in some way to their own injuries-they would be totally barred from recovery in a contributory negligence state. If the state in which the suit is filed has adopted a system of comparative negligence rather than contributory negligence, their recovery will be reduced in direct proportion to their own degree of negligence.
