Why are punitive damages virtually never offered for breaches of contracts?
What will be an ideal response?
The purpose of punitive damages is to punish the misconduct of the defendant. Punishment is most clearly
prime for the criminal law, not contract law. However, treble (triple) damages are available by statute for
contracts that affect public policy such as health club contracts. Additionally, one of the goals of contract
law is to make someone “whole.” Punitive damages would make a plaintiff more than whole.
