If the accused is incapable of assisting in the defense of the case, trial may be delayed until the accused regains sanity. An accused who becomes insane after trial but before sentencing is not sentenced until sanity has been regained. Insanity at the time of the criminal act was committed also absolves the defendant of criminal liability.
