The Constitution and the Bill of Rights provide a number of rights for the accused. Article I, Section 9 of the Constitution assures a right of trial by jury and guaranteed a writ of habeas corpus to know the nature of the arrest and ensure the accused is not held for a long time without charges being filed. The Fourth Amendment provides protection against unlawful search and seizure by government. The Fifth Amendment provides protection against self-incrimination. The Sixth Amendment assures the accused of the right to legal counsel.
