A consent search essentially means that an individual gives the police permission to search their home, vehicle, or other property without a warrant. While a consent search can be a powerful investigative tool, it does have some limitations. First, the search is limited by the statements and actions of the officer. If the officer asks for permission to search a bedroom, then that is the only area that should be searched. Second, the search is limited by the actions and statements of the subject. If the subject says, you can’t search the basement, then officers have to abide by the restriction. Third, the search must be reasonable. Giving an officer permission to search the bedroom, does not mean they can rip the walls apart to look for evidence or break things.
