Disparity refers to inconsistencies in sentencing and/or sanctions that result from the decision-making process. This typically results when the criminal justice system provides an unequal response toward one group as compared with the response given to other groups. Discrimination focuses on attributes of offenders when providing a given sentence. This usually results in a differential response toward a group without providing any legally legitimate reference to the reasons for that differential response.
