The Miranda decision mandated that prior to interrogation the police provide a suspect with a four-part warning. The warning is designed to protect defendants’ right against self-incrimination by informing suspects they are not required to talk to the police, that anything they say may be used against them, that they have the right to be assisted by a lawyer, and that if they could not afford a lawyer, one would be appointed or retained for them. The four-part Miranda warning is intended to “even the playing field” between the police and suspects by providing individuals with the information required to protect their right against self-incrimination. The warning serves to alert suspects that they are involved in an adversarial process and that the police are not on their side in this battle of wits.
