Senate Bill 1391 was passed in July, 2014 and assigned the crime of misdemeanor assault to mothers who used drugs during their pregnancy. Importantly, SB 1391 does not recognize alcohol as an illegal drug nor does it apply to the laws governing abortion. Supporters called it a “velvet hammer,” arguing the law would convince needy mothers to accept the state’s help with the promise of treatment rather than incarceration. In no short time however, this proved not to be the case. Fearing arrest or further legal entanglement, some expectant mothers avoided neonatal care.
