Describe the relationship between Jim Crow policies of the past and "the new Jim Crow," and explain how both have affected the justice system in the United States.

What will be an ideal response?

Varies. A sample answer follows. Under the old Jim Crow system, African Americans were no longer slaves, but they were far from equal. Written and unwritten Jim Crow laws segregated schools and neighborhoods. Authorities segregated prisons as well, and the few education and training programs that existed went to White prisoners. As a result, African Americans were isolated from and had fewer opportunities than White people.
Under "the new Jim Crow," African Americans do not face legal segregation, but law enforcement officers stop, search, and arrest them at much higher rates than the rest of the population. If they go to jail or prison, they often lose jobs and families. Even after release from prison, laws and policies usually prevent them from voting, holding many jobs, and living in public housing. Many people believe that Jim Crow laws are gone, but new Jim Crow–like laws have sprung up and made the justice system less equitable.
