Discuss the pros and cons of a police officer issuing a citation instead of making an arrest for a misdemeanor offense. Which do you feel is the better approach? Why?

What will be an ideal response?

Student responses should include the pros of issues surrounding the indignity and inconvenience of an arrest, the time and effort of an officer and the system when there is an arrest, the profiling minorities arguments, using a misdemeanor as a pretext and the cons that police officers shouldn’t be responsible for determining if the crime is a misdemeanor or a felony, people who commit misdemeanors may be involved in felony crimes as well, and that society benefits when officers can make arrest and take criminals off the streets.
