Premises Liability changes depending on the type of person on the property. The adult trespasser is uninvited and unwanted and is owed minimum duty to protect. The landowner is under no obligation to warn the unknown trespasser of hazards, while once a trespasser is known the owner has a duty to warn of hazards. This duty changes when the trespasser is a child. Children are expected to be drawn, by natural curiosity, to attractive nuisances on property. Should this curiosity result in an injury, then the negligence of the owner must be determined to have been known by the owner and what processes were utilized to provide the duty to warn. Guests of property owners, or licensees, are on the property with the express permission of the owner. The owner has no duty to inspect the property for hazards but once a hazard is identified then the owner has a duty to warn. Under this provision, social guests (postal workers, firefighters, police officers, and other public servants) who are injured on the property due to a foreseeable cause that is not noted may be due damages. Customers in a business premises, or invitees, are the duty to warn by the owner. The owner is required to routinely inspect the property to identify the possible hazards as the business is trying to get patrons to enter the property to make a profit.
