Describe the powers of appellate courts.
What will be an ideal response?
Appellate courts are authorized to do any of the following:
• Affirm a decision
• Reverse a decision
• Modify a decision
• Remand a case for further proceedings
When the court affirms a decision, it enters an order agreeing with the lower court’s determination. When a court reverses a decision, it disagrees with the lower court’s decision and substitutes its own decision as the final outcome. A court may also modify parts of the decision, by affirming part and reversing other parts. Finally, a court may simply refuse to make a ruling and send the case back to a trial court for additional hearings (remand) with instructions that the case be sent back to the appellate court when the hearing is completed.
