A mixed motive case is one where an employment decision is made, such as failure to promote or hire because of a legitimate business reason where an illegitimate reason also exists and could be the motivating factor for the decision. An illegitimate reason would be failure to promote because of a gender stereotyping such as a woman not dressing and talking "more femininely.". A legitimate reason would be a failure to promote a woman because she is abrasive with staff members.
