Explain the buyer's right to specific performance when the seller breaches a contract for the sale of goods.
What will be an ideal response?
Sometimes the goods covered by a contract are unique and it is not possible for a buyer to obtain substitute goods. When this is the case, the buyer is entitled to specific performance of the contract. Specific performance means that the buyer can require the seller to give the buyer the goods covered by the contract. Thus, the buyer of an antique automobile, such as a 1910 Ford, might ask a court to order the seller to deliver the specified automobile to the buyer because it was one of a kind. On the other hand, the buyer of grain in a particular storage bin could not get specific performance if he could buy the same kind of grain elsewhere.
