?Congress enacted the Americans with Disabilities Act (ADA) in 1990 to strengthen existing laws prohibiting discrimination in the workplace against individuals with disabilities. Employerswith fifteen or more employees are obligated to satisfy the requirements of the ADA.As defined by the 1990 statute, disabilities include heart disease, cancer, blindness,paralysis, acquired immune deficiency syndrome (AIDS), serious emotional illnesses, and learning disabilities.Under the ADA, an employer is not permitted to discriminate against a person with a disability ifreasonable accommodationscan be provided to assist the worker in satisfactorily performing the job. An employer is not required to accommodate a worker with a disability if the accommodation would constitute an undue hardship for the employer, however. For example, if the cost of accommodating the employee is extremely high, that high cost might constitute an undue hardship.Although enforcement of the ADA falls within the jurisdiction of the EEOC, the worker alleging discrimination in violation of the ADA may also file a civil lawsuit against the employer for violation of the act.
