Monetary damages are the most common. The amount can vary depending on the type of injury, the type of tort, and the severity of that injury. Most often, these financial awards come in the way of compensatory damages, which are payments for the actual losses suffered by a plaintiff. In some cases, punitive damages may also be awarded, but these awards would be reserved for an offender who had been harmed in a malicious or willful manner by agency staff. A nonmonetary award is a declaratory judgment, which is a judicial determination of the legal rights of the person bringing suit. Another award is an injunction, which requires an agency to take some form of action or to refrain from a particular action or a set of actions.
