The Eighth Amendment prohibition against cruel and unusual punishment applies only to criminal actions. Therefore, the act being punished must actually be a crime. Then, the punishment in question must have either been considered cruel and unusual at the time of the writing of the Bill of Rights or must be considered cruel and unusual by contemporary standards, which change and evolve as society matures.
