Discuss the documentation that parties must submit to the court if the case goes to trial that may be prepared by the paralegal (acknowledging that state dictates may vary).
What will be an ideal response?
Parties must submit updated sworn financial disclosure affidavits, indicating the income, expenses, assets and liabilities of each party. Court-ordered appraisals might also have been ordered. A custody affidavit must be submitted indicating that there is no other proceeding pending in another court that affects the custody of any minor child. The parties must indicate what they want from the disposition of this matter in the form of claims for relief. If there is a default, a military affidavit must be submitted to show the missing party is not currently serving in the military.
To facilitate alimony or child support payment through automatic deduction, a wage execution form is required. A writ of Habeas Corpus might be necessary if one of the parties is incarcerated at the time of trial. The Bureau of Vital Statistics (state-specific) keeps information on divorcing couples, so their form must be submitted for state records. Finally, a written stipulation where the parties agree that certain facts are true, or certain procedures are followed, is submitted. (This list is not all-inclusive and certain forms may have different names in different jurisdictions or states.)
