• Arson is a second degree felony if the accused starts a fire or causes an explosion with the purpose of destroying a building or occupied structure of another, or damaging any property, including her/his own to collect insurance.
• Arson is a third-degree felony if the perpetrator purposely starts a fire or causes an explosion on his or another's property and recklessly places another person in danger of death or serious bodily injury, or places a building or occupied structure of another in danger of damage or destruction.
• Occupied structure means any structure, vehicle, or place adapted for overnight accommodations of persons, or for carrying on business, whether or not a person is present.
