The doctrine of duty of care holds that the police have no duty to protect the general public from harm, unless there is a special kind of relationship and the agency owed a special duty to the injured party. This doctrine has been upheld by the Supreme Court, and adopted at the state and federal levels

A failure to protect may occur if an officer neglects to protect a person from a known and foreseeable danger. This claim most commonly involves battered women but there are other circumstances that can create a duty to protect people from crime. For example, people dependent upon the police, such as informants and witnesses, can be a source of police liability if the police fail to take reasonable action to prevent victimization. The police may not place a person in peril or demonstrate deliberate indifference for a person’s safety.
