Why is negligence so commonly considered in sport litigation?

Negligence is the failure to act as the “reasonable person.” Whether dealing with foul balls, flagrant penalties causing injuries, or defective equipment, judges or juries often have to decide if conduct or equipment fails to act or perform “reasonably.” This is not always easy to determine in the sports context due to the complex plays and differences in athletic talent and ability. However, if an injury was foreseeable and could have been prevented, it is possible that a defendant may be liable in negligence.
