Wilson may bring a defamation action against the newspaper. Defamation is a civil wrong or tort that consists of disgracing or diminishing a person's reputation through the communication of a false statement. Since Wilson is a public official, in order to recover he must prove that the newspaper's statement was made with actual malice. Actual malice requires clear and convincing proof that the paper had knowledge its statements were false or that it acted in reckless disregard of the truth or falsity of its statements.
