Because civil rights are not absolute, the national courts have created "tests" that can be used to determine when unequal treatment is legal. The strict scrutiny test is used to determine the legality of differential treatment based on a suspect classification (race, ethnic origin, religion). The heightened, or intermediate, scrutiny test is used to determine the legality of sex-based discrimination. The ordinary scrutiny or rational basis test is the weakest of the three tests and is used in all other cases of differential treatment, such as in age-based discrimination cases.
