The Miranda safeguards come into play whenever a person in custody is subjected to either express questioning or its functional equivalent. That is, the term “interrogation” under Miranda refers not only to explicit questioning but also to any words or actions on the part of the police
(other than those normally attendant to arrest and custody) that the police should know are reasonably likely to elicit an incriminating response from the suspect. For an interrogation to be conducted lawfully, the following three conditions must be met:
1. The opportunity to interrogate a suspect must be lawfully obtained.
2. There must be an absence of force, the threat of force, or promise of leniency.
3. There must be compliance with requirements for warnings of constitutional rightsto a custodial suspect.
