• A driver was one who was controlling a moving vehicle. This definition caused only a small number of DUI offenders to get convicted so, some states added or substituted the word "operate" in their statutes. This allowed law enforcement to get at the person who obviously drove the car to the location at which it was discovered, but is found slumped over the wheel.
• Even the use of "operate" presented some interpretational problems. Some states defined operate as sitting behind the wheel. Other states required the engine to be running while some required the key to be in the ignition but didn't require that the vehicle be running.
• A few states have abrogated "drive" and/or operate, in favor of "in actual physical control."
