Its legal system is inquisitorial rather than the common law’s adversarial system. The term inquisitorial conjures up images of torture, and the notion that the accused is assumed guilty unless he or she can prove otherwise, all of which is untrue. Rather, it is a system of extensive investigation, interviews, and interrogations to ensure that an innocent person is not subjected to trial (Fairchild and Dammer 2001). The inquisitorial focus is on truth, and not so much on procedure, so many of the procedural protections afforded suspects in common law countries either do not exist or exist in modified form.
