The "diminished culpability" of juveniles was one of the reasons given by the U.S. Supreme Court in its landmark decision in Roper v. Simmons (2005). That case forbade the execution of offenders who were under the age of eighteen when they committed their crimes. In his majority opinion, Justice Anthony Kennedy wrote that because minors cannot fully comprehend the consequences of their actions, the two main justifications for the death penalty-retribution and deterrence-do not "work" with juvenile wrongdoers.
