Both the memorandum of law and the affidavit in support of a motion are intended to assist the judge by providing information beyond that in the complaint or other pleadings. They are different in purpose, however, in that the memo provides arguments of law and authority on which to base a decision, whereas the affidavit provides factual evidence on which to base a decision.
