What is a conspiracy? Why do we punish conspiracies? What if an individual agrees to rob a bank but oversleeps? The group of people he agreed to work with went ahead and robbed the bank without him. Do you believe it is fair to charge the individual who slept in with a conspiracy to rob a bank? Why or why not? Refer to the legal rules in your text to support your answer.

What will be an ideal response?

Conspiracy is an agreement between two or more persons to commit a criminal act. There are three main reasons for punishing conspiracy: (1) intervention – protecting society by arresting individuals before they commit a dangerous crime, (2) group activity – crimes committed by groups have a greater potential to cause social harm, (3) deterrence – group pressure makes it unlikely that the conspirators will be deterred from carrying out the agreement. When analyzing the given case, students must discuss whether there exists an overt act or not as well as whether there are issues with involuntary abandonment of a criminal act.
