There are many different ways and also many limitations when it comes to grandparents and their rights to seek medical attention for their grandchildren. First, a parent may create a power of attorney for the grandparent giving them authority to make medical decisions. All jurisdictions allow for medical treatment of children without parental consent if it is an emergency situation, but this does not apply for routine medical treatment or dental care. Without a medical power of attorney, grandparents may have to seek guardianship, which is often a daunting process and can be costly. Unfortunately, there is no legislation that addresses many of these issues, with the exceptions of medical emergencies.
