1. Rape was originally defined by common law as unwanted sexual intercourse with a woman, excluding one’s wife.
2. Contemporary laws reflect the fact that both men and women can be victims of rape; contemporary laws also now recognize spousal rape as a crime.
3. Rape is defined as carnal knowledge of a person against that person’s will – a definition that covers all sexes and marital status.
4. However, the Model Penal Code defines rape as a male having intercourse with a female other than his wife, and then sets out a series of conditions including force, threats of force, drugging, taking advantage of a female’s unconsciousness or engaging in intercourse with a female less than ten years old. That definition is currently undergoing review and may soon change.
5. The latest FBI definition of rape is “penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.”
