Manslaughter requires proof that the offender was actually aware of the risk of harm whereas criminally negligent homicide requires proof that offender failed to perceive a risk that the offender should have recognized. Awareness or perception of risk is often proven by establishing that offender was violating some other statute at the time of the death.
