Prosecuting attorneys have special duties that only apply to them, and not private practice lawyers. So it follows that the paralegals and legal assistants working for prosecuting attorneys consider those special duties also. Part of those duties that are focused on fairness to defendants includes a restriction on making extrajudicial statements, and being completely forthcoming with the defense’s requests for exculpatory evidence.
