(1) Pretrial approach—a defendant who is arrested for drug possession and who has not been convicted of a crime of violence in the past, with the agreement of the prosecutor, may be diverted from the conventional criminal justice process into the drug court program. (2) Postadjudication approach—defendants plead guilty and then are eligible to enter the drug court program.
