What are the parameters and limitations of the attorney-client privilege?
What will be an ideal response?
Attorney-client privilege—a legal concept that provides protection for communications between a client and his or her attorney and allows the parties to keep those communications confidential. If this privilege didn't exist defendants may not feel secure to confide or provide all the facts or circumstances to the attorney and therefore the attorney may not be able to defend the client to the best ability. In order for the attorney-client privilege to exist the client must seek out a licensed attorney. Any informal conversations or those that occur in a social setting in which free legal advice is given may not satisfy the requirements. It must be established that the communication occurred in a confidential manner, and although the conversation can have other law officer personnel present, it shouldn't occur for example in a crowed nightclub. Attorney-client privileges do not include communications of future crimes the client advises they are going to commit or to seek advice that enables a person to commit a crime. The identity of a client and fee information is not protected.
