Why is careful drafting of the claims in a patent application so important?
What will be an ideal response?
There are two reasons why careful drafting of claims is critical. First, the claims demonstrate that the invention is patentable by showing that the invention is distinguishable from the prior art. Thus, they are important in obtaining a patent in the first place. Then, if the invention is allegedly infringed, a court will examine the claims to determine if infringement has, in fact, occurred. Thus, they are then important in enforcing the patent.
