The just deserts philosophy reflects public sentiment that the offender should receive a harsh sentence as a consequence of his or her criminal behavior. The "get tough on crime" attitude that prevails in contemporary society has resulted in legislatures creating lengthier prison sentences. Thus, while crime rates have dropped, prison populations have continued to rise. The effect has been a perpetuation of prison overcrowding.
