First of all , let us split the two cases given above.
The first case given above explains that Kwabena had an agreement with Paul for to rent a 3 storeyed building and given that Paul fails to pay the rent. And te second case is Kwabena purchased a book for 5000 & paid only 2000.
We were asked to suggest whether Paul & cephas can take legal action against Kwabena.
Answer: Paul & cephascannot take legal action against Kwabena. beacuse as we could see in te question the student stuudies in UPSA which is in Accra , Ghanna & also the East legon is in Ghanna. So, as per the Contract act, 1960 which is used in Ghanna.
The contract act states that any contract entered in to with a Minor is a void. And the minor is not binding the contract. He cannot be sued. So no legal action can be taken against him.
So, since Kwabena is only 17 years old, he is a minor- Paul & Cephas cannot take legal action against him.
