This test asks whether using a celebrity’s name or picture is relevant to a work’s artistic purpose. If it is, the First Amendment, which applies to artistic as well as journalistic works, may allow using the celebrity’s name without permission. However, consent is needed if the name or a celebrity’s likeness is used primarily to give the work commercial appeal.
