When an officer has reasonable suspicion that criminal activity is afoot and that the suspect may be armed, he is allowed to perform a limited pat down of the suspect in the name of officer safety (Terry v. Ohio). This is usually limited to the outer layer of clothing and is done to detect any weapons that the suspect may be carrying. If in the process of the pat down, an officer discovers other nonthreatening contraband, it may be seized, only if it is immediately apparent and is not found as the result of squeezing, sliding, or otherwise manipulating the contents of the subject’s pockets (Minnesota v. Dickerson).
