Investigatory Terry stops may occur only when officers have articulable reasonable suspicion. Otherwise, officers may stop motorists only for violations of the law. However, under this community caretaking doctrine, police officers are allowed, without reasonable suspicion of any criminal activity, to approach and detain citizens for community caretaking purposes. This doctrine does not implicate the Fourth Amendment unless it is determined that the person has been seized. As long as there is an objective basis showing that officers felt the person was in peril or otherwise in need of assistance, then the Fourth Amendment is not implicated. Once the emergency is over, any further actions by the officers may constitute a seizure and the Fourth Amendment comes into play. It is controversial and falls within the gray area expanding police officer interaction with the community, while suggesting that the Fourth Amendment is less important.
