Explain the different purposes of a case brief and a trial brief.

When a court opinion is located and read while conducting research, it is useful to prepare a case brief to summarize the information it contains. The case brief is used by the researcher to help organize the authority on which he will rely in preparing an interoffice memorandum or a trial brief to be filed with the court.

A trial brief is an advocacy document that is intended to persuade the trial judge to reach a conclusion most favorable to the client’s case. Court rules may dictate the form, length and other formalities of the format of the document. If a record from a trial or hearing is to be incorporated in the arguments being made, the record must be carefully reviewed. The statement of the questions or issues presented will be stated in a manner favorable to the client without being misleading. Logical arguments that show the similarity or dissimilarity of the facts of your case with existing law are important aspects of a successful advocacy argument.
