What will be an ideal response?
This first phase is the pre-probate phase and this entails locating the decedent’s will. Once the will is located the family may bring it to an attorney’s office. It is important to try and find the original will and determine that the will in hand is in fact the most recent, complete will. If no will can be located the proceedings will follow intestate. The second stage is the actual probate of the estate. During this stage a petition is file with the court to start the process, and this is followed by testamentary letters being sent to the personal representative to conduct the business necessary to the administration of the estate. At this point beneficiaries will be notified. It is also during this stage that will contests will occur. The final phase is the estate administration. It is then that the personal representative collects the decedent’s property, pays the lawful debts, and distributes the remaining property.
