The exceptions to confidentiality are, disclosing confidential information in order to do your job, discussing confidential information with your need-to-know circle, usually involving the law firm and any outside investigators working on the case. The client waiving the confidentiality of certain information, and defending against client actions if a negligence claim is filed by the client against the law firm or to “collect its fees from the client.” Exceptions to confidentiality also include, if the confidential information becomes “part of the commission of a fraud against the court” or when the client “lets you know about his plans to commit perjury,” when the release of confidential information would help in the prevention of a crime, or when the information is not considered “confidential information” such as a piece of evidence that cannot be hidden from the prosecution.
