Answer: The Fourth Amendment says that all searches must be preceded by the officer's obtaining a search warrant. Regardless of how much probable cause an officer may have, if he or she searches without a search warrant, there is a legal presumption that the search is unconstitutional. There are several conditions in which warrantless searches are authorized and they include: consent searches, searches under exigent circumstances, searches incident to lawful arrest, stop-and-frisk searches, plain-view searches, and automobile searches.
