The fundamental difference is that public organizations administer law. Every element of a public organization, including structure, staffing, budget, and purpose, is the product of legal authority. Other differences involve measures of performance, competing standards, career service, public scrutiny, persuasion, and oversight. The performance of private organizations is tested in the market, whereas the performance of public organizations is measured by their compliance with the law. Efficiency is the ultimate standard among private organizations, whereas equity is also considered important among public organizations. In terms of oversight, the private sector answers to the financial statement, and the public sector is accountable to higher-level administrative officials, the chief executive, legislators, courts, and the public.
